1. Overview

These Terms of Service (“Terms”) govern your use of Project Map, a done-for-you client portal product designed for custom builders and remodelers (“Service”). The Service is operated by Keaten Abbott / Dune Homes, LLC (“Project Map,” “we,” “us,” or “our”), based in Bend, Oregon.

By purchasing, accessing, or using Project Map, you (“Builder,” “you,” or “your”) agree to be bound by these Terms. If you don’t agree, don’t purchase or use the Service.

2. What Project Map provides

2.1 Core service

Project Map builds and configures a branded client portal for your construction or remodeling business. The portal gives your clients a single place to track their project budget, timeline, documents, and selections — all under your brand, not ours.

Your portal is hosted on your own domain or subdomain (e.g., portal.yourbusiness.com or yourbusiness.buildprojectmap.com) and is built on Google Firebase (Google Cloud infrastructure).

2.2 Setup (included)

Every subscription tier includes setup at no additional charge. Setup includes:

  • Custom branding (your logo, colors, and domain)
  • Custom domain or subdomain configuration (see tier table below)
  • QuickBooks Online integration
  • Budget tracking, project timeline, file storage, and selections features
  • Unlimited client projects
  • Team onboarding and training
  • Ongoing support for the life of your subscription

2.3 Subscription tiers

The recurring subscription includes Firebase hosting, uptime monitoring, ongoing feature updates and improvements, and support. There is no setup fee on either subscription tier, and each tier includes a 14-day free trial — you are not charged until the trial ends, and you may cancel at any time during the trial without being billed.

  • Remodeler: $199/month or $2,150/year (saves 10%). Includes 2 seats; additional seats are $20/seat/month. Hosted on a yourbusiness.buildprojectmap.com subdomain.
  • Builder: $349/month or $3,780/year (saves 10%). Includes 5 seats; additional seats are $20/seat/month. Includes custom-domain hosting and white-label branding.

You may cancel the subscription at any time — cancellation takes effect at the end of the then-current billing period (see Section 10.1).

Own It (one-time license): Project Map is also available as a one-time, perpetual license. The current founding rate is $7,500 (one-time) for the first ten licenses, after which the standard rate of $15,000 applies. The Own It tier includes a self-hosted deployment, source code, Year 1 updates and support, and ongoing support thereafter starting at $99/month. The Own It tier is governed by these Terms together with the separate Own It addendum delivered at purchase.

2.4 What Project Map is not

Project Map is a software implementation and hosting service — not a general contractor, financial advisor, or legal advisor. We aren’t responsible for decisions made using the portal or for the outcomes of your projects.

3. Payment terms

3.1 Setup fee

There is no setup fee on the Remodeler or Builder subscription tiers. Setup is included in your subscription.

The Own It one-time license fee is due in full at the time of purchase. The current founding rate is $7,500 for the first ten licenses, after which the standard rate of $15,000 applies (or such other amount as quoted in writing). Year 1 updates and support are included; ongoing support thereafter starts at $99/month.

3.2 Subscription fee & trial

The recurring subscription fee is $199/month (or $2,150/year) for the Remodeler tier and $349/month (or $3,780/year) for the Builder tier (or such other amount as quoted in writing), billed in advance via Stripe. Additional seats above each tier’s included allotment are billed at $20/seat/month.

Each subscription includes a 14-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, your card will be charged for the first billing period (monthly or annual, as selected at checkout) and the subscription will continue on that schedule until canceled.

3.3 Billing and payment processing

All payments are processed through Stripe. By providing payment information, you authorize Project Map to charge your payment method for all applicable fees. It’s your responsibility to keep your payment information current.

3.4 Late or failed payments

If a subscription payment fails and isn’t resolved within 7 days of notice from us, we reserve the right to suspend your portal until payment is received. If payment isn’t received within 30 days of a failed payment, we may terminate your subscription and take your portal offline pursuant to Section 10.

3.5 Fee changes

We may change the subscription fee with at least 30 days’ written notice to you. Your continued use of the Service after the new rate takes effect constitutes acceptance of the new price. If you don’t accept the new fee, you may cancel before the new rate applies. Founder pricing, where offered, is locked in for the life of your subscription unless you cancel.

4. Refund policy

4.1 Subscription fees

Each subscription begins with a 14-day free trial. You may cancel at any time during the trial without being charged. Once the trial ends and the first billing period (monthly or annual) is charged, fees are non-refundable for any portion of a billing period already begun.

If you cancel mid-period, your portal will remain active through the end of the paid billing period, after which it will be taken offline. Annual subscriptions are not pro-rated upon cancellation.

4.2 Own It (one-time license)

The Own It one-time license fee is non-refundable once delivery has commenced. “Delivery has commenced” means we’ve started any portion of the build, deployment, or source-code handoff, including domain setup, branding application, Firebase project creation, QuickBooks integration, or repository delivery.

If you cancel before any delivery work has begun (i.e., within 48 hours of payment and before any configuration has started), you may request a full refund. Refund requests must be submitted in writing to keaten@dunehomes.com.

5. Your responsibilities

To ensure a smooth setup, you agree to:

  • Provide branding assets (logo, brand colors, fonts) in a timely manner and in usable file formats.
  • Provide timely feedback during the setup process. Extended delays caused by your unavailability may push back launch timelines. Project Map isn’t responsible for delays attributable to your failure to respond.
  • Maintain your QuickBooks Online account if you want the integration to remain functional. Any changes to your QuickBooks account that affect the integration are your responsibility to communicate to us.
  • Maintain a valid payment method on file with Stripe for monthly billing.
  • Use the portal lawfully — see Section 6 below.
  • Keep your login credentials secure. You’re responsible for all activity that occurs under your account and your clients’ accounts within your portal.

6. Acceptable use

You agree not to use Project Map or your portal to:

  • Violate any applicable law or regulation
  • Transmit any content that is unlawful, fraudulent, defamatory, harassing, or otherwise objectionable
  • Introduce viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to any system or network
  • Resell or sublicense access to the platform to third parties without prior written permission from Project Map
  • Impersonate any person or entity

We reserve the right to suspend or terminate your portal immediately if we determine, in our reasonable judgment, that you’re in violation of this section.

7. Data ownership

7.1 Your data is yours

You own all data that you and your clients input into your portal (“Builder Data”), including but not limited to project information, client records, documents, budgets, timelines, and communications. Project Map doesn’t claim ownership of your data.

7.2 How we use your data

We access your Builder Data only as necessary to provide and support the Service — for example, to troubleshoot issues, perform maintenance, or fulfill your support requests. We don’t sell your data or use it for advertising.

7.3 Data security

Your portal is hosted on Google Firebase, which provides industry-standard security measures. While we take reasonable steps to protect your data, no system is 100% secure. You acknowledge that transmitting data over the internet carries inherent risk, and Project Map isn’t liable for unauthorized access that is beyond our reasonable control.

7.4 Your clients’ data

You’re responsible for obtaining any necessary consents from your clients for storing their information in your portal, and for complying with any applicable privacy laws. Project Map acts as a data processor on your behalf with respect to your clients’ data.

8. Intellectual property

8.1 Project Map platform

Project Map owns all right, title, and interest in the underlying codebase, platform architecture, templates, and technology that power your portal (the “Platform”). These Terms don’t transfer ownership of the Platform or any part of it to you.

8.2 Your license

When you start a subscription or purchase a one-time Own It license, Project Map grants you a limited, non-exclusive, non-transferable license to use your configured portal instance for your internal business operations — specifically, to manage your construction projects and communicate with your clients. For the hosted Remodeler and Builder subscriptions, this license is conditioned on your continued compliance with these Terms and your continued payment of the subscription fee. For the Own It one-time license, the license is perpetual and survives termination of any optional ongoing support plan, subject to your continued compliance with these Terms.

8.3 Your branding

You retain ownership of your logos, trademarks, and other branding materials that you provide to us. You grant Project Map a limited license to use your branding solely for the purpose of configuring and displaying your portal.

8.4 Feedback

If you provide suggestions or feedback about the Service, you agree that Project Map may use that feedback freely to improve the platform without compensation to you.

9. Service availability

9.1 Reasonable uptime

We make reasonable efforts to keep your portal available and performant. However, we don’t guarantee any specific uptime percentage or service level.

9.2 Firebase dependency

Your portal runs on Google Firebase (Google Cloud). Service availability is partly dependent on Firebase’s own uptime and reliability. Outages, disruptions, or changes caused by Google are outside our control, and Project Map isn’t liable for downtime caused by Firebase or any third-party infrastructure provider.

9.3 Maintenance

We may take your portal offline temporarily for scheduled or emergency maintenance. We’ll make reasonable efforts to provide advance notice of scheduled maintenance and to schedule it during off-peak hours.

10. Cancellation and termination

10.1 Cancellation by you

You may cancel your monthly hosting subscription at any time by providing written notice to Project Map. Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued.

10.2 What happens when you cancel

Upon cancellation or termination of monthly hosting:

  • Your portal will be taken offline at the end of the paid billing period.
  • You’ll have 30 days from the date your portal goes offline to request an export of your Builder Data. After 30 days, we may delete your portal’s data from our servers and are under no further obligation to retain or provide it.

We encourage you to export your data promptly if you decide to cancel.

10.3 Termination by Project Map

We may suspend or terminate your account immediately and without prior notice if:

  • You materially breach these Terms and fail to cure the breach within 14 days of written notice (or immediately for breaches that can’t be cured, such as illegal activity or serious acceptable use violations)
  • Any payment is more than 30 days overdue
  • We determine that continued hosting creates a legal or technical risk

If we terminate your account for reasons other than your breach, we’ll provide you with the same 30-day data export window described above.

10.4 Survival

Sections relating to payment obligations already incurred, intellectual property, data ownership, limitation of liability, indemnification, and governing law survive termination of these Terms.

11. Disclaimer of warranties

The service is provided “as is” and “as available.” Project Map makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We don’t warrant that the service will be error-free, uninterrupted, or free from security vulnerabilities.

12. Limitation of liability

To the fullest extent permitted by law:

  • Project Map’s total liability to you for any claim arising out of or related to these Terms or the Service — whether in contract, tort, or otherwise — is limited to the greater of (a) the total fees you paid to Project Map in the 12 months immediately preceding the claim, or (b) $500.
  • Neither party is liable to the other for any indirect, incidental, special, consequential, or punitive damages (including lost profits, lost data, or business interruption), even if advised of the possibility of such damages.

Some jurisdictions don’t allow limitations on certain warranties or liability, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless Project Map, Keaten Abbott, Dune Homes, LLC, and their respective officers, employees, and contractors from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party right
  • Content or data you or your clients submit to your portal

Project Map will promptly notify you of any claim subject to this section and will cooperate reasonably with your defense.

14. Modifications to these Terms

We may update these Terms from time to time. When we do, we will:

  • Post the updated Terms at buildprojectmap.com/terms (or such other URL as we designate)
  • Update the “Last updated” date at the top of this document
  • Provide at least 14 days’ advance notice via email to the address on your account for any material changes

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you don’t agree to the revised Terms, you must cancel your subscription before the effective date.

15. Governing law and dispute resolution

15.1 Governing law

These Terms are governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict-of-law principles.

15.2 Venue

Any disputes that can’t be resolved informally will be brought exclusively in the state or federal courts located in Deschutes County, Oregon. Both parties consent to personal jurisdiction in those courts.

15.3 Informal resolution first

Before filing any legal action, both parties agree to attempt to resolve any dispute informally by giving written notice of the issue and allowing 30 days for a good-faith response and resolution attempt.

16. General provisions

16.1 Entire agreement

These Terms, together with any written quotes or order forms referencing them, constitute the entire agreement between you and Project Map regarding the Service and supersede any prior discussions or agreements.

16.2 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

16.3 No waiver

Our failure to enforce any right or provision of these Terms doesn’t constitute a waiver of that right or provision.

16.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. Project Map may assign its rights and obligations freely, including in connection with a merger, acquisition, or sale of assets.
